SPECIAL LEAVE PETITON (SLP)

Supreme Court of IndiaArticle 136 of the Constitution of India confers power upon the Hon’ble Supreme Court of India to grant Special Leave to Appeal. In order to make this appeal you need to file Special Leave Petition (SLP) before the Hon’ble Supreme Court of India. This SLP can be filed from any judgment, decree, determination, sentence or order in any cause or matter passed or made by any court or tribunal in the territory of India, except the judgment, determination, sentence or order passed or made by any court or tribunal constituted by or under any law relating to the Armed Forces.

Basically, Hon’ble Supreme Court of India has power to adjudicate upon any case arising out of any judgment, decree, determination, sentence or order in any cause or matter passed or made by any court or tribunal in the territory of India. However, it is not necessary that Hon’ble Supreme Court entertains any Special Leave Petition, it is only in those where there is a substantial question of law to be decided and the non-resolution of the such substantial question of law is causing grave injustice to the parties.
